Overview
Welcome to Diving Mentoring LLC. These Terms and Conditions govern your use of our website, services, and online mentoring sessions. By creating an account, booking a session, or using our website, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before purchasing or participating in any mentoring session.
Eligibility and Account Information
- You must be 18 years old or older OR under the supervision of a parent or guardian to use our services.
- You agree that all information you provide (including contact details, athletic information, and session details) is accurate, truthful, and up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Divers must have their coach’s approval before using our services. By using our site and any of the services offered, divers represent that they have obtained approval from their coach.
Mentoring Sessions
- Our mentoring sessions are conducted via Zoom and are recorded for the safety of both the athlete and the Mentor (Max Flory).
- Parents of minors are encouraged to attend sessions. Parents are welcome to join any session, and if the participant is under 18 years old, a parent or guardian’s presence is encouraged (but not required) for transparency and safety.
- Our services are designed as a developmental tool to support divers in their training and growth as an athlete. We do NOT guarantee or promise specific results or performance outcomes.
- Within 24 hours of the conclusion of your session, you will receive a document containing your personalized plan. This can be found on your account in your messages.
Video Analysis Sessions
- Video analysis sessions are designed to provide personalized feedback based on the footage and information you have shared with the Mentor. While you may upload multiple clips for review, we may not review every individual video during a single session.
- The purpose of the videos you provide is to give the Mentor context to the skills or issues you want to address, and to allow the Mentor to find good examples for comparison. This means that the Mentor will determine which clips are most relevant and use session time to focus as in depth as necessary to analyze the specific problem areas and deliver meaningful feedback. Time spent per video will differ on a case by case basis.
- Uploading additional videos does not guarantee that each one will be reviewed in detail during the session. However, before the session the Mentor will review all of the allotted 1-5 videos uploaded by the athlete to ensure a full understanding of their issue and offer the best services possible.
- All videos must be submitted 24 hours before your scheduled session. This allows the Mentor adequate time to prepare and review materials prior to your appointment. Videos submitted after this time may not be considered during that session.
- Athletes agree to follow the submission limits as outlined: no more than 5 videos per session may be uploaded for review. Any videos submitted beyond this limit may not be reviewed and may be deleted at our discretion.
Messaging Policy
- Upon purchasing a package of 4 or 8 sessions, athletes gain access to the messaging feature within their account. This feature allows you to communicate directly with your Mentor for questions, clarifications, or to share brief updates related to your sessions.
- Response Time: Messages will typically receive a reply within 24 hours during regular business days. Response times may vary on weekends or holidays.
- Appropriate Use: Messaging is intended for brief communication related to your mentoring sessions. It should not be used for emergency inquiries, extended consultations, or unrelated topics.
- Access Expiration: Once you have completed all sessions included in your purchased package, your access to messaging will automatically end. If you wish to continue messaging access, you must purchase an additional package.
- We reserve the right to monitor and manage messaging interactions to maintain a professional and supportive environment.
- If you are found to be in violation of the messaging policy, or using the messaging feature inappropriately, your messaging privileges may be revoked and your account may be subject to suspension or termination.
Messaging with Minors:
- To use our services, minors are required to be under the supervision of a parent or guardian. Likewise, all messaging from minors is required to be under the supervision of a parent or guardian.
- Messaging access to minors is provided with the understanding that a parent or guardian is aware of and consents to the use of messaging as part of the mentoring experience.
- We strongly encourage parents to monitor communications or send messages themselves on behalf of the athlete whenever possible to ensure clarity and transparency.
- Messaging with minors is limited strictly to session-related topics including scheduling, feedback, and general mentoring guidance. Personal, unrelated, or inappropriate conversation of any kind is strictly prohibited.
- All messages are subject to review or audit to ensure compliance with youth protection and professional conduct standards.
- If at any time inappropriate communication is suspected, messaging privileges may be suspended or revoked immediately, and the matter may be referred to the parent or guardian.
- Parents or guardians may contact us at any time to review, restrict, or disable their child’s messaging access.
Refund Policy
- All sales are final. No refunds are provided once a session or package has been purchased.
- Please review your session selections carefully before completing your booking.
Late Arrivals
- Sessions begin and end at the scheduled times.
- If you arrive late, the session will still end at the originally scheduled time. Your lateness will reduce your available mentoring time, and no extensions or credits will be provided.
Cancellation Policy (Mentor Cancellations)
We do our best to honor all scheduled sessions. However, in rare cases where the Mentor’s schedule changes unexpectedly and a session must be cancelled:
- You will be credited back for the cancelled session in your account.
- To rebook, log in to your account, click on “Packages,” and you will find your credited session available for rescheduling.
- We do not issue refunds for Mentor cancellations.
- Rescheduling the session is the sole form of compensation.
Rescheduling Policy (Customer-Initiated Changes)
- You may reschedule a session up to 24 hours before the scheduled start time.
- To reschedule:
- Log in to your account.
- Click on “Sessions.”
- Find the session you wish to change, click on the three dots, and select “Reschedule.”
- Choose a new available date and time that works for you.
- Sessions can NOT be rescheduled less than 24 hours in advance and will be forfeited if missed.
Payment Terms
- Payments are securely processed through Stripe, our third-party payment processor.
- We do NOT store your credit card details.
- By submitting payment information, you authorize us and Stripe to process payments for the selected services.
- All payments must be completed before sessions can be scheduled.
Liability and Disclaimer
- All mentoring and advice provided through our services are for educational and guidance purposes ONLY.
- You acknowledge that participation in athletic activities involves risk.
- We are not liable for any injury, loss, or damages (direct or indirect) that result from your participation, training decisions, or the application of our advice.
- You agree to hold Diving Mentoring LLC, its owners, Mentors, and affiliates harmless from any claims, damages, or losses arising from your use of our services.
Intellectual Property
- All materials shared during sessions (including videos, training plans, and website content) are owned by Diving Mentoring LLC.
- You may not copy, distribute, or share these materials without written permission of Diving Mentoring LLC.
- Any videos or materials you upload remain your property, but you grant us a limited, non-exclusive license to review and use them solely for mentoring and feedback purposes.
Privacy and Data Protection
- We respect your privacy and handle your personal information according to our Privacy Policy.
- By using our services, you consent to the collection and use of your information as described in that policy.
Prohibited Uses
You agree NOT to:
- Use the services for any unlawful purpose.
- Upload or share content that is inappropriate, abusive, or infringes on another person’s rights.
- Attempt to disrupt or interfere with the operation of the website.
Violation of these rules may result in account suspension or termination without notice.
Disclaimer of Warranties
Our services are provided “as is” and “as available.” We make no warranties, expressed or implied, regarding:
- The accuracy or completeness of content or advice;
- The reliability of technology platforms (Zoom, Stripe, etc.);
- The results of any mentoring session or athletic improvement.
Limitation of Liability
To the fullest extent permitted by law:
- Diving Mentoring LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.
- Our total liability, if any, shall not exceed the total amount paid by you for services in the twelve (12) months preceding the claim.
Indemnification
You agree to hold harmless and indemnify Diving Mentoring LLC, its affiliates, employees, and partners from any claims, liabilities, damages, or expenses arising from:
- Your breach of these Terms and Conditions;
- Your misuse of the services; or
- Your reliance on any information provided during mentoring sessions.
Governing Law
These Terms and Conditions are governed by and construed under the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in Miami-Dade County, Florida.
Changes to These Terms
We may modify these Terms and Conditions at any time. Updated versions will be posted on this page with the revised effective date. Continued use of our services after changes constitutes your acceptance of the new Terms and Conditions.
